Terms and Conditions

The following terms and conditions are binding on every PawnQ customer and will inure to the benefit of PawnQ, its successors and assigns.

Requirements for Use

Pawnq.com is a licensed DBA of Ancor Gold Inc,a New York Corporation. DCA Lic# 1374833. Pawnq.com complies with all New York pawnbrokers statues. By applying for a Pawn Loan and shipping your property to Pawnq.com and agreeing to the Pawn loan agreement, you acknowledge and agree to the pawn loan.

The following terms and conditions are binding on every PawnQ customer and visitor to Pawnq.com. If you do not agree to be bound by this Agreement, restrain yourself from using this website and services offered on this website.

Permitted Users

Pawnq.com and all offered services are available only to those who can lawfully enter into and form contracts under New York law. If you are under the legally required age to enter into contracts, or if you are accessing Pawnq.com from a location other than New York, you may be restricted from accessing this website and its services if its material and services are illegal or restricted in the region you are accessing this website from. If you choose to access Pawnq.com while in a region outside of New York, you do so at your own risk and on your own initiative and you obtain the responsibility to comply with your own state’s law.

PawnQ Services

All loans issued by PawnQ depend on our approval of your application and our assessment of your valuable items. PawnQ has the rights to refuse any Loan applications at any time before completion of the PawnQ Loan process. In order to apply for a Loan issued by PawnQ, a completed PawnQ Loan application is required, which is found at start-now. When pawning with us, a Pawn Ticket Agreement is set up. This means by law we are required to provide you with a PawnQ Ticket which includes a description of your valuable item, the terms of the PawnQ Ticket Agreement, how to void the sale before completion, service charges and fees, interest rates, and the total amount required to void the sale and get back your valuable item.

Restrictions on our Services

On our sole discretion, we retain the right to accept certain Pawn Loan applications. We only accept PawnQ Loan applications with a minimum of $200 and up to $100,000, which is stated under our Money and Rates section. It is solely under our discretion if we decide to accept Pawn Loan applications of more than $100,000. We only accept certain valuable items, which are stated on our What We Loan On section. We retain the right to refuse certain items as collateral if and when we wish to do so.

Fees

When applying for a PawnQ Loan, you will be allowed the chance to review and accept any fees and charges in connection with your PawnQ Loan. All Pawn Loan amounts have an interest rate of 4%, which is stated in our “Money and Rates” section. If any, applicable taxes will be charged. All fees are quoted in U.S Dollars. On our sole discretion, we reserve the right to make changes to our standard fees and rates. If any changes are to be made, the new updates will be posted in the Money and Rates section on our website and be applied to those who apply for a Pawn Loan from the date of the amendment.

Shipping

PawnQ cannot be held responsible for any damages to your items due to being sent in inappropriate packaging. It is your responsibility to make sure that your items are packaged securely. PawnQ has the right to refuse any packages that seem to be damaged or tampered with and reserves the right to return them to you. When shipping your packaged valuables, you can ship them through the courier service provided by us through FedEx, where we cover the costs of shipment and its insurance through FedEx and Lloyd’s of London. Alternatively, you can send your package through a courier of your choice, if you wish to do this it will be at your own expense.

You can find out more information on how to make a shipment with FedEx in our Delivery section. If you choose to use our service with FedEx, your valuable items will be insured for up to $150 through FedEx and will be covered by our insurance provider Lloyd’s of London after that. If you wish to insure your items for more than $150, or wish to ship your items faster than our standard FedEx 2nd Day Air service, you can do so at your own expense. If you choose to use your own courier service provider, we advise you to make sure your package is fully insured to its full value. You must obtain a receipt with a tracking code for shipping from the shipping agent, which will give you the ability to track your package or use the receipt to make an insurance claim if you need to. You must keep photographic records of your items as well as documentation which proves ownership of said items with any insurance claims.

Copyright

By using our website, you agree never to use any parts of our website which may be considered illegal. You are prohibited from using screen shots as the PawnQ website contains copyrighted material which is owned by PawnQ

Pricing

We seek to make sure our pricing and product information are kept accurate. If there appear to be any errors, we retain the right to correct those issues, and have the ability to refuse or cancel any orders made for any item that has been posted with an incorrect price.

If you use Pawnq.com or its services, you agree not to abuse, harass, threaten, defame or violate the legal rights of privacy and publicity of PawnQ. You agree never to offer to sell any item that is not legal to sell, or anything that would cause Pawnq.com to violate any law, regulation or statute. You agree to inform Pawnq.com promptly of any suspected or known unauthorized use or breach of this Agreement. PawnQ will work together with Internet service providers and legal authorities in releasing information about users who breach this Acceptable Use Policy.

Remedies

In order to protect PawnQ, third parties and/or yourself from any liability or any violation of this Agreement, your Member account or our Services may be limited in accessibility, suspended or even closed. We may contact law enforcement, or affected third parties of your actions; and possibly restrict you from using any of our services.

Protection

You agree to hold PawnQ, its agents, officers and other partners, harmless from any loss, claim, liability, or demand such as attorney’s fees in relation of your usage of Pawnq.com website or its services or results from your violation of this Agreement.

Warranty

You warrant that any valuable item you use to seek to obtain a Pawn Loan with Pawnq.com are your sole and absolute property and that you have good and marketable titles/rights to them. Such Properties are not encumbered in any way and there are no liens or any form of adverse claims of ownership against them. You agree that using Pawnq.com and its services is solely at your own risk. PawnQ provides the site and all content thereon “AS IS”, “AS AVAILABLE”, “WITH ALL FAULTS”, and without any express or implied warranties including but without limitation to, any implied warranty of merchantability, title, fitness for a particular purpose, and non-infringement.

PawnQ does not warrant that the PawnQ website is secure or safe, nor does PawnQ guarantee that the website is free from any errors, interruptions or timely. PawnQ does not warrant to accuracy of any content on its website, as well as making any corrections to it.

Limitation of Liability

In no event will PawnQ be liable to any third party, including any insurance providers. PawnQ shall not be liable for any abrogation claim brought by the customer's insurance provider. By submitting property to PawnQ, all customers expressly and particularly waive any such abrogation claims on their behalf as well as on the behalf of their insurance providers.

PawnQ’s liability is and will be expressly and particularly limited to the LEAST of the following sums: The liquidation value placed on the property by PawnQ is at our sole discretion. One third (1/3) of the appraised value of the property according to an appraisal carried out by an independent accredited appraiser submitted by a customer to PawnQ, said appraisal has to have been issued no more than 3 years before the shipment and not after shipment of the property to PawnQ to the sum of $100.00. You as a PawnQ customer, acknowledge and agree that PawnQ's liquidated value shall be conclusive and binding and further, in no event will PawnQ's liability exceed $100.00.

PawnQ will not be liable to anyone for any damages, including but not limited to consequential, incidental, punitive, loss of profit or opportunity, other than as described above. If your valuable item is lost or damaged during the duration of your Pawn Loan period and it’s in PawnQ’s possession, you acknowledge and agree that you cannot repurchase the item, but you will not be obliged to pay any charges or fees to PawnQ as stated in the Pawn Ticket Agreement.

By sending any property to PawnQ, the customer undeniably accepts this limitation of liability.

Governing Law

Any claim relating to Pawnq.com shall be governed by the laws of the State of New York without regard to its conflict of law provisions. Therefore you herewith adhere to the exclusive jurisdiction of and in, courts located in New York, USA in all disputes deriving from or relating to pawnq.com and its services. You hereby agree that at our sole discretion PawnQ is allowed to apply for injunctive or other equitable relief in any court of suitable jurisdiction.

Improperly Filed Claims

All claims between PawnQ and yourself must be resolved in accordance with this Legal Dispute Section. If you file a claim contrary to said Legal Dispute Section, PawnQ may recover up to $1000 in attorney fees. Hence if you fail to immediately withdraw the claim and PawnQ has informed you about the Improperly Filed Claim in writing. All claims will be considered improperly filed if the claim is filed as aforementioned and/or contrary to the Legal Disputes Section.

Limitation on Claims

Any claims or cause of action in relation to this website, Agreement, and PawnQ’s services must be commenced within one year after the cause of action occurs. If the claim is not commenced within this time frame, such action is permanently barred.

Communications

Communications between yourself and PawnQ are mainly through electronic means, such as communicating via email or accessing information through our website. You give consent to being communicated with using an electronic form from PawnQ, and agree that all terms and conditions, notices, agreements and other communications that PawnQ provides to you electronically satisfy as if it were in hardcopy writing; this does not affect your non-waivable rights. General

These terms and conditions contain the entire Agreement that binds every PawnQ customer and Pawnq.com visitor to PawnQ in regards to using PawnQ’s website and its services. If any provision of said Agreement is held invalid, the rest of this Agreement will continue and be enforced to its full effects. Regardless of any other provisions herein, the parties agree no individual, corporate body and/or entity shall be seen or acknowledged as a third party beneficiary of this agreement. If any provision of this Agreement becomes void or ineffectual, such a provision will be corrected and interpreted to achieve its purpose to the highest extent under any and all applicable laws and the rest of said provisions still stand in full. If PawnQ should ever fail to enforce or use any rights or provision of this Agreement the failure to use said rights will not equate to or act as a waiver of said rights or provision.

The titled sections in this Agreement are for ease of navigation only and have no appropriate or legal impact. Please get in touch with us with any concerns regarding this Agreement. You may not lease, rent, license, offer a protective interest in, or otherwise transfer, assign, or sublicense your privileges herein to any third party. At any moment, PawnQ may, at our sole discretion and without supplying notice or acquiring your approval, assign this complete Agreement or delegate some or all of its responsibilities herein.

If any provision of this Agreement is seen to be incorrect or unenforceable, such provision shall be removed and all other terms shall still be valid and enforceable. Sectioned headings are for ease of navigation reasons only and do not restrict the scope or breadth of said section. Our failure to act with respect to a violation by you or others doesn't waive our right to act with respect to pursuing subsequent or identical violations. We do not guarantee we will take measures against all violations of this Agreement.

This Agreement places forth the complete comprehension and agreement between us with regards to the topic hereof. The following sections endure any cancelling of this Agreement: Charges and Services (with respect to fees due for our services), Release, Content, Obligation, Indemnity and Legal Disputes.

Changes to this Agreeement

PawnQ may make amendments to this agreement. If any changes are to be made to this agreement, we will inform you via the personal email address which you provided when setting up an account with us. Any amendments to this agreement will be effective 30 days after informing you about said changes. Your access from that point on to the PawnQ website or use of our services shall constitute your acceptance of the amended Agreement once the new agreement takes place. 

If you do not agree to be bound by said Agreement and its potential amendments, restrain yourself from using this website and all services offered on this website.
